The Designer'S Original Design Protection Law Is Expected To Be Implemented.

The designer's original design protection law is expected to be implemented.

On Wednesday, ABS by Allen Schwartz began selling a series of wedding dresses inspired by royal wedding. One of the wedding dresses looks like the new princess Kate wearing the Alexander McQueen wedding dress at a price of 1100 dollars. Also on Wednesday night, Republican Representative Bob Goodlatte reintroduced a law to reissue a decree to protect the designer's right to design and combat similar ABS behavior. This Friday, Proenza Schouler brand designer Jack McCollough and Lazaro Hernandez also went to Washington to deal with their tort lawsuits.

Everything looks familiar. Five years ago, the American Fashion Association implemented an activity aimed at introducing the act of protecting the original rights of designers. At that time, the advocates said that the law was likely to be passed. But this law is too generic. Producers complain that the law will trigger accusations of design rights, and designers hope to narrow the definition of the act. In the improved law, designers need to provide very strong evidence that the design of the plagiarism is surprisingly similar to that of the original. In addition, designers need to provide relevant evidence to prove that they are original, and the plagiarism is very clear about this fact. Of course, the similarity between color and shape can not be regarded as plagiarism.

Steven Kolb, director of Fashion Association, said: "if the act is passed, the designer's works will be very limited." But to be honest, it's not easy to find a designer who can receive the protection of this act. ABS's copy of Alexander McQueen design is indeed obvious, which may become a successful example.

If this law can be passed, it should be a great victory for designers, especially those who are seriously injured by persecution.

But obviously, Mr. Schwartz does not agree with this view. He said: "many things in fashion can not see who will go first. After all, many designs follow the same trend and have no specific name." Mr. Schwartz even improved the details of many red carpet dresses and launched his own evening dress series inspired by red carpet.

Proenza Schouler brand designer Jack McCollough and Lazaro Hernandez are very persistent. They are determined to win the infringement lawsuit. Mr. Hernandez said: "we spent 3 million US dollars to design and develop our unique design, but the profit we profit from is infringed by these infringements, which is very unfair to us. Our unique design represents the unique characteristics of the Proenza Schouler brand, and their plagiarism is a blasphemy for all our efforts.
